Advertise Only Agreement
Agency Agreement Between Harry Albert Lettings & Estates And The Advertiser
1. We will;
- Take all information as provided and creating a property advertisement.
- Advertise the property on our own website (www.harryalbertgroup.co.uk) and several property portals for up to a maximum of six months or until the property is let, whichever is sooner.
- Provide as necessary any additional services formally agreed in writing external to this agreement (which may include: writing component parts of the listing, interviewing and selecting tenants, arranging/carrying out viewings, drafting tenancy agreements).
- Forward relevant enquiries to the landlord (in line with General Data Protection Regulations) and/or forward landlord details to enquirers.
2.1 Our fee for the Advertise Only Service is £49
2.2 The above fee will become payable prior to any listing or advertisement going live.
2.3 If you require other services in line with section 1.3 of Our Service (above), we will agree a price and payment terms separately to this agreement
3.1 Whilst we shall use our best commercial judgement in the provision and the execution of our Service hereunder, we shall not under any circumstances be liable for any outcomes and shall not be held liable for the quality of leads or tenants.
3.2 We endeavour for all listings to go live within 24 hours. Where this fails, you must allow for up to 72 hours. Beyond this, you will be entitled to a refund. Where refunds are granted, this agreement is terminated and any listings will be removed.
3.3 We will not be held liable for any failings by yourself or anybody else relating to any non-compliance of health and safety, housing laws and regulations, landlord-tenant law or any relevant Acts applicable to the renting or sale of any property.
3.4 We will advertise your property on our website and any property portals for a maximum of 6 months from the date the property advertisement goes live on our website or until the property is let, whichever is sooner.
3.5 The above fees are payable per individual advertisement.
3.6 Any future revisions to your property advert after the listing is advertised on our website will incur a fee of £10 to cover the cost of administration, this fee is payable prior to revision and no revisions shall take place until payment has been confirmed.Please Note: Where we must make revisions or request you make revisions to the property details or photographs, you will not be charged any fee for revision of the listing.
3.7 We reserve the right to alter this agreement from time to time, any changes to this agreement will not affect any previous agreements already in place until such time the agreement expires. Expiration will be from the date the property is let or six months after the listing goes live on our website. Any and all changes will be valid from the expiration date with any subsequent agreements thereafter.
3.8 By going ahead with, by making payment for or by submitting the form titled "Form for Advertise Only Service", agreement to these terms will be implied.
3.9 By undertaking our service, you confirm you own or have authorisation from the owner to advertise any properties you submit to us for the purposes of undertaking our services.
3.10 For your listing to be eligible for listing on property portals, we will require at least one image.
3.11 We reserve the right to alter, make changes or otherwise revise your listing at any time without notice or agreement if we feel it is misleading or unlawful. We will inform you immediately should this occur.
3.12 We reserve the right to remove any listing we feel is unlawful or misleading without any refund being granted in this event. WE will inform you immediately should this occur.
3.13 You agree to indemnify, hold harmless and accept liability for any and all legal costs and compensation, fines or other costs incurred as a result of any breaches of these terms.
4.1 These terms and conditions, their subject matter and formation (and any non-contractual disputes or claims) are governed by and construed in accordance with English law.
5.1 If any part of these terms and conditions is deemed invalid, illegal or for any reason unenforceable then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under these terms and conditions or otherwise shall not be construed as a waiver by us of those or any other rights or remedies.
5.2 All rights not expressly granted in these terms and conditions are reserved.
